CFRA 2021 Impacts on FEHA/ADA, Work Comp, Pregnancy and Medical Leaves: Red Flags for Small and Large Employers with Beth De Lima, SHRM-SCP, MBA
The new CA CFRA Amendments raise risk to small employers trying to manage and control medical leaves for employees under CFRA for the first time, with and without COVID-19. Employers with over 50 employees now have a brand-new set of leave benefits that include with grandparents, siblings, and adult children, as well as other benefits, with up to 24 weeks of CFRA and non-CFRA-FMLA leave. Employers with five or more employees will be providing up to 12 weeks of job-protected/benefit-protected leave plus 17 1/3 weeks of Pregnancy Disability Leave, as well as potential leave under ADA/FEHA when CFRA ends. In this comprehensive deep-dive workshop, you will learn the tricks and strategies to staying compliant and out of court while assuring your employees are getting access to leave and accommodation benefits, without running afoul to the new CFRA.
Lisa Aguiar, Michael Sullivan & Associates Attorney of Counsel, practices employment law exclusively, and represents a wide range of businesses.
Ms. Aguiar represents private- and public-sector businesses in all aspects of employment law defense. She develops defense strategy from initial claim through trial, with an emphasis on preventing litigation and reducing exposure. She is an experienced advocate for large companies with a unionized workforce. Among her notable successes are favorable resolutions of claims with the National Labor Relations Board and administrative audits by the Department of Labor, Department of Labor Standard Enforcement and the Employment Development Department.
Ms. Aguiar has expertise handling wage and hour disputes, claims of discrimination, harassment, retaliation and violations of the ADA. Ms. Aguiar has worked on hundreds of cases in both federal and state court, resolving countless cases through mediation and other forms of alternative dispute resolution. She is a certified business coach and assists her clients in employment-mandated training as well as workshops to develop the leadership and communication skills of managers and executives. Ms. Aguiar counseled her clients in matters of hiring, termination, compensation and severance. She negotiated proprietary/confidentiality agreements and advised about technology policies. She successfully defended against a multimillion-dollar overtime/bonus claim by employees of a multinational manufacturing company.
Ms. Aguiar most recently co-authored Navigating COVID-19: A Legal Guide for Employers, a comprehensive guide that helps decision-makers, human resource professionals, risk management teams and the like interpret and apply employment law, immigration law and workers’ compensation.
Ms. Beth De Lima is founder & principal of HRM Consulting, Inc. and Leave Management Solutions, LLC providing human resources, vocational rehabilitation consulting and HR training/coaching, and expert testimony services. She has been assisting HR managers and business owners with compliance and procedural implementation for managing and integrating family medical leaves (CFRA, FMLA, COVID-19) ADA/FEHA, pregnancy, disabilities, workers’ comp and FMLA since 1993 on a national, statewide, and local level. Ms. De Lima has extensive expert-witness experience regarding harassment, discrimination and wrongful termination as well as providing HR and vocational rehabilitation expert-witness testimony opinions for wrongful termination cases—and historically for Social Security and Longshoreman disability hearings for almost three decades.
