Under a law that took effect in 2018, California employers with five or more employees are required to provide sexual-harassment-prevention training every two years to all employees, including one hour of training to nonsupervisors and two hours of training to supervisors.

Full-time, part-time and temporary employees are included in the employer's head count, whether they work at the same location or work or reside elsewhere in California. The employer is responsible for the training costs. Employers cannot require employees to complete the training during personal time, so workers must be paid for attending.

The initial training deadline was Jan. 1, 2020, but employers now have until Jan. 1, 2021, under SB 778, which Gov. Gavin Newsom recently signed into law.

Starting Jan. 1, 2021, new employees must be trained within six months of their hire date, and newly promoted supervisors must be trained within six months of their promotion.

This training is interactive and practical, teaching supervisors essential management skills while discussing the legally required harassment related topics.

The seminar will cover:
• Explanation of protected categories
• Address SB 396 requirements
• Types of harassment and bullying
• Responsibility of supervisors and companies
• How to conduct an investigation
• Best practices

Additionally there will be a “Train the Trainer” Session for qualified individuals.
This session is designed for human resources professionals who are experienced in the area of sexual harassment training and investigations, to learn how to conduct the training at their company.

Who is eligible to attend train the trainer?

• HR Professionals with two years’ experience handling claims of sexual harassment
• Trainers specializing in sexual harassment prevention
• Attorneys that specialize in labor law
• University professors that teach labor law

Class participants will receive an overview of requirements of the law and what must be covered in each session. They will then go through a presentation that details how to teach the class and discuss the required topics. They will receive the following digital materials which they can customize for their company sessions:

• Model PowerPoint for training class
• Sign-in sheet
• Certificate of attendance
• Master harassment policy

1. Understand the protected categories under state and federal law.
2. Understand how their company needs to comply with the requirements under SB 396.
3. Understand how to recognize different types of harassment and bullying in the workplace.
4. Learn how to conduct an investigation of a harassment complaint.

SPEAKER BIO

Aburish_Hassan
Hassan Aburish is an associate Fisher Phillips' San Francisco office. He
focuses on employment litigation and counseling for employers in a
wide range of issues including wage and hour, discrimination,
harassment, leaves and accommodations, retaliation, and wrongful
termination.

Hassan has experience defending employers in federal and state
courts, as well as in investigations by the Equal Employment
Opportunity Commission (EEOC), the Department of Fair
Employment & Housing (DFEH), and the California’s Labor
Commissioner’s Office.

While in law school, Hassan served as law clerk for the Office of the
California Attorney General where he prepared investigative
subpoenas and reviewed documents for state and federal privacy
investigations.


Isola_Anthony
Anthony Isola is an associate in Fisher Phillips’ San Francisco office. His practice focuses on representing employers in the area of labor and employment law.

Anthony litigates in multiple areas of employment law and defends against lawsuits alleging violations of wage and hour laws, whistleblower, wrongful termination, discrimination, harassment, retaliation, breach of contract, defamation, unfair competition, labor
code section 132a claims, and other related matters. Anthony represents employers in state and federal courts, as well as before the DLSE, EDD, and other administrative bodies. He advises employers on employee relations, discipline/discharge matters, employee leave laws, handbook preparation, personnel policies, employment contracts and applications, day-to-day strategic advice, and risk management.

During law school, Anthony served as a law clerk for the Honorable A. James Robertson II of the San Francisco Superior Court and as a certified law clerk for the San Francisco District Attorney’s Office where he made frequent courtroom appearances to argue felony
preliminary hearings.

In 2017 and 2018, he was selected as a Super Lawyers Rising Star – an honor awarded to no more than 2.5 percent of the lawyers in California.
